1. General

Any and all use of the ASCONA Website is subject to these Terms of Use. ASCONA reserves the right to amend, modify or replace these Terms of Use at any time. Upon logging-in, or where a log-in is not required, on accessing or using the Website, you accept these Terms of Use in their current version. Any use of the ASCONA Website is at your own risk.

2. Accessibility of the ASCONA Website

Due to the nature of the Internet and computer systems, ASCONA does not warrant that the ASCONA Website is continuously available. ASCONA additionally reserves the right to stop operating and/or providing this Website, in full or in part, at any time and until further notice.

3. Use of the ASCONA Website and the contents and information provided

All information made public by ASCONA will be provided for the user – unless stated otherwise – free of charge. Every user may use and document (download) the offered information for his or her own personal needs. Any other use or exploitation of the information, especially replication, alteration or integration in publishing or advertisement of any kind, is only permitted with the prior consent of ASCONA or the owner of the information in question. ASCONA specifically draws attention to the fact that contents and information can be subject to protective rights. Any such protective rights (especially names and trademarks) shall remain the property of ASCONA at all times.

All information provided by ASCONA has been researched and compiled with the greatest care and to the best of its knowledge and belief and, where it originates from third parties, has been used without modification. However, every user shall be responsible himself or herself for checking that the provided information is correct, complete and up-to-date. Liability on the part of ASCONA due to the fact that information is incomplete, not up-to-date or incorrect, as well as liability for any consequences of possible misinterpretation of the provided information by the user, shall be restricted to cases of gross negligence and intent on the part of ASCONA.

In using the ASCONA Website, the user shall also always ensure that he or she does not through such use or related actions:

– cause damage to persons or violate their rights of personality

– offend common decency

– infringe proprietary rights, copyrights or other rights of ownership

– transfer contents with viruses, Trojan horses or other programming that might damage software

– enter, save or send hyperlinks or contents that the user is not authorized to enter, save or send, in particular if these hyperlinks or contents violate obligations to maintain confidentiality, are unlawful, in breach of contract or simply deliberately incorrect and/or

– disseminate advertising or unsolicited e-mails (“spam”) or incorrect warnings against viruses, malfunctions or the like or incite persons to take part in competitions, snow-ball systems, chain letters, pyramid games or comparable activities.

ASCONA shall not be liable for damage incurred by the user due to misuse of the information offered.

4. References and links

In the case of direct or indirect references to external Internet pages (“links”) that are outside the author’s sphere of control, liability shall only be assumed if the author is aware of the contents and it would be technically possible and reasonable for the author to prevent its use if the contents are unlawful.

ASCONA expressly declares that no illegal contents were discernable on the linked page at the time the link was set. ASCONA has no influence on the current and future design, contents or authorship of the linked pages. Consequently, ASCONA hereby distances itself expressly from all contents of all linked pages that have been modified after a link has been set. This applies to all links and references set within its own Internet offering and to external entries in visitors’ books or discussion forums set up by the author or to damage resulting from the use or non-use of such offered information. The provider of the page that was referred to, and not the party that merely references the publication in question via links, shall be solely liable.

5. Copyright and identification

6. Important note on computer viruses

Although ASCONA makes every effort to keep the ASCONA Website free of viruses, ASCONA cannot warrant that the ASCONA Website is free of viruses or accept liability if it is not. Before downloading information, software and documentation, the user shall undertake adequate security precautions and use suitable virus scanners for his or her own protection, as well as to prevent viruses from infiltrating the ASCONA Website.

7. Data protection

If there is the possibility of entering personal or business data (e-mail addresses, names, addresses) within the Internet offering, this information is disclosed by the user on an expressly voluntarily basis. The use and payment of all the offered services is – where technically possible and reasonable – also permitted if such data is not specified or if anonymized data or a pseudonym is used.
